New – WCB Decision Making Policy for Review

The Workers Compensation Board (WCB) of Prince Edward Island has approved, in principle, a new policy on Decision Making. The purpose of the draft new policy, POL-## Decision Making, is to explain the factors that are considered when the Workers Compensation Board (WCB) makes decisions on claims, including how the WCB gathers information, assesses evidence, and applies legislation and policy. It also streamlines the process for consideration of new evidence for decisions under appeal. The draft policy incorporates amended content from three WCB policies, POL-62 Benefit of Doubt, POL-68 Weighing of Evidence, and POL-83 New Evidence. If approved the new policy, POL-## Decision Making, would replace these policies.
The proposed policy, POL-## Decision Making:
• Explains the WCB’s legislated authority to make claim decisions (1)
• Sets out the WCB’s responsibility to gather sufficient information (4, 6, 7) and for workers, employers and health care providers to provide information to the WCB (5)
• Differentiates between information and evidence (8)
• Provides a framework for assessing all types of information and evidence (9, 10, 11)
• Clarifies how the benefit of doubt is applied to decision making (13, 14)
• Explains how legislation and policies are applied (15, 16)
• Sets out the requirements for communicating decisions (18)
• Includes content on reconsiderations (19)
• Removes administrative burden to request a review on new evidence in writing with rationale (21)
• Authorizes the Internal Reconsideration Officer to consider new evidence (26, 27, 29, 30)

This policy has been placed on the Workers Compensation Board of PEI website for viewing and comment. It will remain on the website until June 11, 2020 under the heading of “Policy Consultation-Draft Policies”.
