The Department of Economic Growth, Tourism and Culture is inviting organizations and the general public to provide feedback on a proposed Temporary Foreign Worker Protection Act. The Temporary Foreign Worker Protection Act is new legislation that will be considered by the Legislative Assembly of PEI.

About the Proposed Legislation

The Temporary Foreign Worker (TFW) Program allows Canadian employers to hire foreign workers to fill temporary jobs when qualified Canadians are not available. There has been an increase in number of TWFs on the Island over the past number of years. Although the Government of Canada runs the TFW Program, matters such as working conditions generally fall to the provinces. There have been calls over the past several years to create additional protections for TFWs.

This proposed legislation will:

• Require foreign worker recruiters to be licensed, and employers who recruit and hire temporary foreign workers to be registered.
• Establish criteria for issuing, refusing, suspending or cancelling a licence or registration.
• Impose penalties for recruiters and employers who violate the legislation.
• Allow government to recover, and return to workers, any fees charged illegally by recruiters.
• Create two registries, one for foreign worker recruiters and one for employers.
• Create a positive obligation on recruiters and employers to supply TFWs with written contracts and information on their employment rights.
